Why mediation versus litigation?
Litigation is an adversarial and delayed process that destroys
relationships and permits a judge or jury to impose a final win-lose decision.
Mediation, in contrast, is much more economical and efficient
than going to court, especially since the parties split the cost of mediation.
Legal representation is encouraged, but not required, as is consultation,
with a variety of other experts if the parties so choose. All the parties
and their representatives work together for a fair solution.
Mediation can be used at any stage of a dispute, before or after a suit has been filed. Many courts refer cases to mediation because of its high success rate - largely because the parties understand their case and the nuances of their relationship better than anyone else.
A vast majority of those who participate in mediation are
satisfied with the process, especially since it is less time consuming
and less expensive than traditional venues, and most cases are successfully
resolved.
Regardless of the reason for choosing mediation, research
demonstrates that people prefer mediation to all other dispute resolution
methods.
